Terms of Service

1. About this agreement

These Terms of Service are the agreement between you and 125 Ventures LLC, a Wyoming company doing business as TurboHeadshots ("TurboHeadshots", "we", "us"). They govern turboheadshots.com and the AI headshot service we provide through it (the "Service").

By uploading a photograph, verifying an email address, or paying for a session, you agree to these Terms, to our Privacy Policy and to our Refund Policy. Those two documents are part of this agreement. If you do not agree to them, do not use the Service.

Section 15 requires most disputes between us to be resolved by individual arbitration, and waives your right to a jury trial and to take part in a class action. You can opt out of that within 30 days by sending one email — Section 15.4 says exactly how.

2. Who may use TurboHeadshots

You must be at least 18 years old to use the Service, and old enough to enter into a binding contract where you live. The Service is not directed to children and we do not knowingly let anyone under 18 use it.

Every photograph you upload must show a person who is also at least 18. We do not generate headshots of minors, whoever uploads the photograph.

If you accept these Terms on behalf of a company — for example when you buy team seats — you confirm you are authorized to bind it, and "you" means both you and that organization.

3. What the Service does

You upload one clear photograph of a face. We check that it is usable, prepare it, and generate AI headshots from it. Before you pay anything, we show you watermarked previews of headshots we have already generated at our own cost, so you can see what the Service produces for your photograph before deciding whether to buy.

If you like what you see, you pay once for a session. You then choose outfits and backgrounds from our catalog, we generate the rest of the headshots in your package, and you download them one at a time or as a single archive.

The previews and the headshots generated after payment are one product and one package — not a free sample followed by a separate purchase. The previews are part of what you are buying, which is why you get to see them first.

Every headshot is generated by artificial intelligence. It is a new image created from your photograph, not a retouched copy of it. Output varies between photographs and between sessions, and in any set some images will be better than others. What a package includes — how many photographs, how many outfits, how many backgrounds — is shown at checkout before you pay.

We do not sell subscriptions. Every purchase is a one-time payment. Nothing renews, and there is nothing to cancel.

4. Your photograph

4.1 What stays yours

You keep ownership of every photograph you upload. Nothing in these Terms transfers it to us.

4.2 The permission you give us

You give us permission to use your photograph solely to operate the Service for you: to store it, prepare it, send it to the AI providers named in our Privacy Policy so your headshots can be generated, show it and your headshots back to you, and help you with support.

That is the whole of it. We take no right to publish, display, sublicense or market your photograph, and we do not use your photograph or your headshots to promote TurboHeadshots unless you separately and explicitly agree to a specific use.

Your photographs are never used to train AI models — not ours, and not our providers'. That is a term of this agreement, not only a policy statement.

4.3 What you promise about it

When you upload a photograph you confirm that:

  • it shows you, or it shows someone who has given you permission to upload their photograph and to have AI headshots generated from it;
  • every person shown in it is at least 18 years old;
  • you have all the rights needed to upload it, including any rights held by the photographer;
  • you are not using it to impersonate anyone or to mislead anyone about who a person is; and
  • uploading it does not break any law or any other person's rights.

4.4 What we may refuse

We check uploads automatically and we may refuse or remove a photograph — before or after payment — if it fails those checks, shows more than one person, appears to show a minor, or looks likely to breach Section 9. If we refuse a photograph before you have paid, nothing is charged.

5. Your account

We identify you by email address and a one-time code sent to it. Keep access to that inbox: anyone who can read it can reach your headshots. You are responsible for what happens under your account, and you agree to tell us at support@turboheadshots.com if you think someone else has got into it.

We may suspend or close an account that breaks these Terms, and we may keep records of a closed account where the law requires it.

6. Prices, payment and what a session includes

Prices are shown in US dollars at checkout, before you pay. The price you accept at checkout is the price for that session; later price changes do not affect a purchase you have already made.

Payments are processed by Stripe. Your card details go to Stripe directly — we never receive or store them. You are responsible for any taxes that apply to your purchase where those are not collected at checkout.

Team seats are sold per seat. A seat is valid for 12 months from the date of purchase; a seat still unused after 12 months expires and is not refundable. Refunds of unused seats before then are covered by our Refund Policy.

7. Refunds

Our Refund Policy is part of this agreement and sets out the whole of it. In short: the free previews exist so that you can judge the result before paying, and downloading any headshot from a paid session ends refund eligibility for that session. Requests made within 30 days of purchase, before any download, are refunded in full.

We look at anything outside that on a case-by-case basis, and we refund technical failures, duplicate charges and unauthorized transactions whatever the timing.

8. Teams

A team owner buys seats and invites people by email. Each invited member uploads their own photograph to their own seat.

A team owner and any team administrator can view and download the headshots generated on a member's seat, and those views and downloads are recorded against the person who made them. If you invite someone to a team, you are responsible for telling them this before they upload anything, and for having whatever permission your organization needs to ask them for a photograph.

Removing a member from a team deletes the photograph on that seat and frees the seat for someone else. Seats expire 12 months after purchase (Section 6).

9. Acceptable use

You agree not to:

  • upload a photograph of anyone who has not agreed to it, or of anyone under 18;
  • use the Service to impersonate a person, to misrepresent who someone is, or to create an image intended to deceive;
  • upload or try to generate sexual, nude, violent, hateful or harassing imagery, and never any material that sexualizes a minor;
  • use the Service for anything illegal, or in breach of anyone's intellectual property, privacy or publicity rights;
  • remove, obscure or work around the watermark on a preview, or try to obtain an unwatermarked image without paying for it;
  • scrape, crawl, or use bots, scripts or other automation against the Service, or try to get at parts of it you have not been given access to;
  • reverse engineer the Service, probe its security, or interfere with its operation for anyone else; or
  • resell, sublicense or transfer your access to the Service.

Breaking this section can end your access immediately, and where money has been spent generating images we may decline a refund for the session involved.

10. Your headshots

We assign to you whatever rights we have in the headshots generated for you. They are yours — use them on LinkedIn, on a résumé, on a company website, in print, commercially or personally, without paying us anything further.

Two honest caveats. AI systems can produce similar images for different people from similar inputs, so we cannot promise that a headshot is unique. And you are responsible for how you use your headshots, including any impression they create about you.

11. Availability, changes and storage

We may change, add or withdraw features, packages, outfits and backgrounds at any time, and the Service may be unavailable from time to time for maintenance or for reasons outside our control.

We do not promise to store your headshots indefinitely. Download the ones you want and keep your own copies. How long we keep photographs and generated headshots is set out in our Privacy Policy, and we may delete them after the periods described there or if you ask us to.

12. Disclaimer of warranties

THE SERVICE AND EVERYTHING IN IT, INCLUDING EVERY GENERATED HEADSHOT, IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

AI OUTPUT IS PROBABILISTIC. WE DO NOT WARRANT THAT ANY HEADSHOT WILL RESEMBLE YOU TO YOUR SATISFACTION, WILL SUIT A PARTICULAR USE, OR WILL BE FREE OF ARTIFACTS OR ERRORS. THE FREE PREVIEWS ARE PROVIDED ON THE SAME BASIS, AND EXIST SO THAT YOU CAN JUDGE THE RESULT BEFORE PAYING.

Some states do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITIES, OR LOST OR CORRUPTED DATA, ARISING OUT OF OR RELATING TO THE SERVICE.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (b) US$100.

Some states do not allow these limits, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.

14. Indemnification

You agree to defend and indemnify us against any claim, loss or cost arising from a photograph you upload, from how you use your headshots, or from your breach of these Terms — including a claim brought by a person shown in a photograph you uploaded.

15. Disputes and arbitration

15.1 Talk to us first

Most problems are a support conversation. Before starting arbitration or any other proceeding, email support@turboheadshots.com describing the problem and what you want. Give us 30 days to sort it out.

15.2 Agreement to arbitrate

If we cannot resolve it, you and we agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules, and governed by the Federal Arbitration Act.

Any in-person hearing will be held in the county where you live, and the arbitrator may also decide the case on documents or by video. The arbitrator can award the same individual relief a court could.

15.3 What is not covered

Either of us may bring a qualifying claim in small claims court instead, and either of us may ask a court for an injunction to stop misuse of intellectual property. Nothing here stops you from reporting anything to a government agency.

15.4 How to opt out of arbitration

You can opt out of this section within 30 days of first accepting these Terms. Email support@turboheadshots.com with the subject "Arbitration opt-out", stating your full name, the email address on your account, and that you are opting out of arbitration. That is all it takes — one email, no form, and no effect on anything else in this agreement or on your use of the Service. If you opt out, disputes go to the courts described in Section 16.

15.5 No class actions

Disputes will be arbitrated only on an individual basis. You and we each waive the right to bring or take part in a class, collective, consolidated or representative proceeding, and the arbitrator may not preside over one. If this paragraph is found unenforceable for a particular claim, that claim leaves arbitration and goes to court, and the rest of this section still applies to every other claim.

16. Governing law and where claims are heard

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules.

For anything not resolved by arbitration under Section 15, you and we agree to the exclusive jurisdiction of the state and federal courts located in Wyoming — except that you may always bring a qualifying claim in small claims court where you live, and except where the consumer-protection law of your home state gives you a right to a different forum that cannot be waived.

17. Copyright complaints

If you believe something on the Service infringes your copyright, send a notice to support@turboheadshots.com, or by post to 125 Ventures LLC, 30 N Gould St Ste N, Sheridan, WY 82801, including: your signature (electronic is fine); identification of the work; where the material is on the Service; your address, phone number and email; a statement that you believe in good faith the use is not authorized; and a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for them.

If your material was removed and you believe that was a mistake, you may send a counter-notice to the same address with the equivalent information. We end the accounts of repeat infringers.

18. Changes to these Terms

We may update these Terms. The date at the top always shows the current version. If a change is material we will tell you by email or in the Service before it takes effect. Continuing to use the Service after that means you accept the new version; if you do not, stop using the Service and ask us to delete your data.

19. Notice to California residents

Under California Civil Code §1789.3, California users are entitled to this notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210. 20. General

These Terms, with the Privacy Policy and Refund Policy, are the entire agreement between us about the Service. If any part is found unenforceable, the rest stays in force. Our not enforcing something is not a waiver of it. You may not transfer this agreement; we may transfer it to a successor in connection with a merger, acquisition or sale of assets.
